There are different options that may arise for married couples. California is a community property state and an experienced attorney is required for all of the issues that may arise with your property rights and properly dealing with community and/or separate assets and debts. Nullity cases may arise in voidable marriages or in cases of fraud, force, or fear. Legal Separation may be an option for couples that need to stay married but wish to establish separate households and determine property rights.
Parentage cases present unique problems. Mothers often need support and assistance with the expense of birth. Father's rights can often come into play when they are denied visitation or need to contest support issues. Genetic testing may be required in cases where the parentage is uncertain or contested.
The standard in California is that custody orders should be based upon the best interest of the minor child. Custody is often one of the most heavily contested areas. Custody cases can involve many issues including custody (Evidence Code 730) evaluations, move-away cases, grandparent and step-parent rights, as well as many other factors. Early representation in a contested custody situation is imperative.
The formulas and legal basis for child support is often confusing for many parties. A support payee may struggle with getting sufficient support to meet expenses. A support payor may be the target of a government case and face garnishments, license suspensions, and arrearages issues. Often issues of support are intertwined with custody litigation and a party may be facing litigation before multiple judges. Competent representation will help you achieve a fair and reasonable result.
The rule of thumb that support is available for half the length of the marriage is often cited. However, it is important to realize that the need for support must be properly established and should reflect the marital standard of living. Marriages that are over ten years may be considered long term, resulting in lifetime support. Whether you are receiving support or paying support, you will need solid representation to see you through the process.
Domestic violence is a serious and contentious area. A battered spouse may need the immediate protection of the courts. Minors may be in danger from actual violence or exposure to that violence. Unfortunately, there are also times when a party may be falsely accused and need aggressive representation on his/her side. Criminal charges may also play a part. At our firm, we are ready to assist with all of these issues.
Fully mediated dissolutions are becoming more commonplace. Parties that are willing to work together can save a great deal of money and headaches by coming together to cooperate with a trained mediator. Our firm offers mediation services to assist in reducing the conflict that so often accompanies dissolution, parentage, custody, or support matters. Give us an opportunity to help you resolve your matter peacefully.
